I just dont understand why they even charged for oversea online sale. This is so stupid. I dont think other European country did this too. But as me living in Moscow, their gst 16% but none charged to online shopping (non-russian state)

AFAIK, all EU countries, UK and switzerland imposed VAT for online purchases, except for a few exempted items like books.... So, no surprises.

^^VAT only for purchases to within the EU. None outside of EU. Including online purchases.

Yes i was talking in the context of the european resident buying stuffs online abroad even from Malaysia, we (the european countries resident) will be imposed with VAT too, ie. Responding to cubex01 post saying it's unreasonable for Malaysian custom to impose GST for online purchase for importation to Malaysia...

Of course, i agree ....as you rightly pointed out, if the EU resident bought items online for consumption within EU they will be levied with 19-22pct VAT. On the other hand, if Malaysian purchased an item from EU countries online for consumption outside EU, the 19-22 pct VAT will be exempted but the MAlaysian buyer SHOULD be charged with Malaysian GST (by law) if those online purchases are imported to Malaysia......for consumption in Malaysia.....

True that. Vat/gst basically is consumption tax. The tax is levied at where you consume the product.

You are right too. But detax is not applicable to local residents. That is one of the rule. Every vat country practice that.

so i manage to retrieve my watch from the Unit Tahanan Kastam yesterday but the experience was a funny one.
As usual my ebay guy declared the value of the item to be lower than the amount paid via Paypal but still > RM500 and hence my item kena tahan. Upon collection, the officer there asked for invoice or proof of amount paid and i didn't bring any. To my surprise the office asked me to log on to my Paypal acc using the PC in the office to show him proof of the amount paid. BUSTED !!!

Next the officer started calculating the ACTUAL amount of tax based on my paypal statement and also started asking me to unbox the item to show him the item. The minute he saw the watch, he turned very friendly and he told me that he is also an avid fan of japanese watches and started helping me out in reducing the amount of gst. He immediately thought of using the postage stated amount as the actual value i got a huge discount. I walked out the office with my new watch smiling. Must be my lucky day.

I collected my watch from Fedex today after it was held by customs for 4 days
They attempted to charge gst for it (both value and freight) but after numerous calls and
presentation of documents they agreed to release it without any charges.

What u need in case this happens to u

1/ keep the original airway bill stating u sent the watch overseas for claims/repair
2/ ensure watch's serial number is indicated in the awb
3/ ask for a document acknowledgement by customs that watch is sent for repair and will be returned back (courier co will provide)
4/ once watch is repaired and on its way back, present these documents to the appointed courier co

I'm just glad pink lips didn't get my gst this round...
